These Terms of Service explain the rules for using Canada Web Insights, including acceptable use, intellectual property, disclaimers, and how disputes are handled. 1) Acceptance and eligibility

These Terms of Service (Terms) govern your access to and use of the Canada Web Insights website, including any pages, articles, and resources published on it (collectively, the Site). The Site is operated by Canada Web Insights Inc. (we, us, or our). By accessing or using the Site, you confirm that you have read and understood these Terms and agree to be bound by them.

Minimum age: you must be at least 16 years old to use this Site. If you are under 18 years old, you represent that you have permission from a parent or legal guardian to use the Site. If you do not agree to these Terms, do not use the Site.

2) Service description (what we provide)

Canada Web Insights is a neutral, article-style information service focused on how online tools and digital platforms are being explored across Canada. The Site provides topic overviews, trend summaries, user-centered perspectives, and practical resources such as definitions, checklists, and guidance on comparing common features (for example: account recovery, notification settings, accessibility options, and privacy controls).

Readers should verify details directly with the relevant platform, especially where decisions may affect accounts, payments, privacy settings, or data retention.

3) User obligations

You agree to use the Site only for lawful purposes and in a way that does not infringe the rights of others or restrict or inhibit anyone else’s use and enjoyment of the Site. When you submit a message through Contact, you agree that the information you provide will be accurate to the best of your knowledge and will not contain content that is unlawful, abusive, or misleading.

If the Site offers optional features that rely on browser storage (for example, remembering cookie choices), you agree not to interfere with those features in a way that harms the Site’s operation or other users. You also agree not to attempt to bypass access controls or security measures on the Site.

You may not copy, reproduce, republish, distribute, display, perform, modify, create derivative works from, sell, license, or exploit the Site or any content for commercial purposes without our prior written permission. You may not use our name, logo, or article formatting in a way that suggests endorsement of any product, service, or viewpoint.

5) Prohibited activities

You agree not to engage in any of the following when using the Site:

  • Scraping, crawling, harvesting, or bulk downloading content using automated means without permission.
  • Attempting to reverse engineer, decompile, or otherwise discover the source code or non-public logic of the Site, except as permitted by law.
  • Interfering with or disrupting the Site, servers, or networks, including by introducing malware, harmful scripts, or excessive load.

  • Impersonating any person or entity, or misrepresenting affiliation with any organization.

  • Using the Site to engage in fraud, illegal activity, or to facilitate wrongdoing of any kind.

We reserve the right to take appropriate action if we believe prohibited activity has occurred, including blocking access, limiting requests, or preserving relevant records as necessary for security and legal compliance.

6) Disclaimer of warranties

The Site and all content are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties and representations, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Site will be uninterrupted, secure, error-free, or free of viruses or other harmful components. We do not warrant that content will be complete, current, or accurate for every platform or jurisdiction. Information about third-party products and services can change without notice. 7) Limitation of liability

To the maximum extent permitted by applicable law, Canada Web Insights Inc., its directors, officers, employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities arising out of or related to your access to or use of (or inability to use) the Site or any content, even if we have been advised of the possibility of such damages.

To the maximum extent permitted by applicable law, our total liability for any claim arising out of or related to the Site or these Terms will not exceed the amount you paid to us for use of the Site in the twelve (12) months immediately preceding the event giving rise to the claim, or €100, whichever is lower. If you have not paid any amount, the cap will be €100.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you. In such cases, our liability will be limited to the fullest extent permitted by law.

8) Indemnification

You agree to indemnify, defend, and hold harmless Canada Web Insights Inc. and its directors, officers, employees, contractors, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from or related to: (a) your use of the Site; (b) your violation of these Terms; (c) your violation of any law or regulation; or (d) your infringement of any third-party right.

We reserve the right, at our own expense, to assume the exclusive defence and control of any matter subject to indemnification by you, and you agree to cooperate with our defence of such claims.

9) Third-party links and references

The Site may reference third-party tools, services, or platforms for informational context. We may also include links to third-party websites. Third-party websites and services are not under our control, and we are not responsible for their content, availability, policies, or practices. Linking does not imply endorsement.

Your interactions with third parties are solely between you and the third party. You should review the terms and privacy policies of any external service you use. Any disputes, billing issues, or account issues with third-party services must be resolved directly with those providers.

10) Privacy and cookies

11) Governing law and jurisdiction

These Terms and any dispute or claim arising out of or relating to them or the Site will be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of laws principles.

Subject to the dispute resolution section below, you agree that the courts located in Toronto, Ontario will have exclusive jurisdiction over any disputes arising out of or relating to these Terms or the Site, and you submit to the personal jurisdiction of those courts.

12) Dispute resolution (informal first)

Before filing any claim, you agree to try to resolve the dispute informally by contacting us and providing a description of the issue, your preferred resolution, and any relevant information. You can contact us using the details in the Contact section below or via Contact.

The parties agree to attempt informal resolution for at least thirty (30) days from the date we receive the notice of dispute. If the dispute is not resolved within that period, either party may pursue a claim in the courts specified in the Governing Law and Jurisdiction section, unless applicable law requires a different approach.

13) Termination and enforcement

We may suspend, limit, or terminate your access to the Site at any time, with or without notice, if we reasonably believe you have violated these Terms, created security risk, or misused the Site. We may also take technical measures to protect the Site, such as rate limiting or blocking certain requests.

Upon termination, the license granted to you to use the Site will end. Sections that by their nature should survive termination will survive, including Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law and Jurisdiction, and Dispute Resolution.

14) Modifications to these Terms

We may update these Terms to reflect changes to the Site, legal requirements, or operational practices. When we make changes, we will update the “Last Updated” date at the top of this page. Unless a change is required to take effect immediately for legal or security reasons, updates will be effective fourteen (14) days after posting.

Your continued use of the Site after the effective date of an updated version of these Terms constitutes your acceptance of the updated Terms. If you do not agree with any update, you must stop using the Site.
